La recente attività normativa ecclesiale: finis terrae per lo ius canonicum?

The monograph analyzes the ecclesial legislative production, namely that of the last five years of the current pontificate. Generally, problems of imperfect drafting can be found in it, such as poor attention to formal aspects, inaccurate terminology, inner incoherence and lack of coordination with the whole legal system. Such an unsatisfactory drafting negatively affects the regulation of the substantial legal relationships involved and often has a harmful - and sometimes serious - effect on the rights and the condition of the faithful, as it is explained in the present study. One of the reasons of such a defective formulation is identified with the increasingly marginal role that seems to be reserved for the Pontifical Council for Legislative Texts and - with it - for the legal science. The volume therefore outlines some proposals in order to face the difficult challenges that emerge in front of the Church in the third millennium: through the elaboration of an adequate and effective Canon law, which is up to its glorious tradition and - above all - is more and more consistent with justice.
